Identify the correct maintenance filing

For applicable U.S. national registrations, a Section 8 declaration is generally due in years five to six. Combined Sections 8 and 9 filings are generally due in years nine to ten and each later ten-year cycle.

Review continuing use and ownership

Confirm the owner and the goods or services still in use. Gather genuine specimens for the relevant items and discuss changes that affect the filing. An optional Section 15 declaration is considered separately.

Prepare for the actual window

We review the registration and required filing before agreeing the service. Certain filings allow a six-month grace period with extra fees. Madrid-based U.S. registrations have Section 71 maintenance and separate international renewal requirements.

Is the five-year filing a renewal?

The first required filing is generally a declaration addressing continued use or qualifying excusable nonuse. The applicable renewal application comes later.

What if the filing window has passed?

Promptly review the record and any applicable grace period. A canceled or expired registration needs a different assessment from an upcoming maintenance filing.

Can the team quote this from the registration number?

The registration number is a useful starting point. The team also needs current owner and use information to confirm the work and fees.
